• What Has Changed?

In 2009, Congress passed the HITECH Act, which overhauled parts of HIPAA and gave the Office of Civil Rights (OCR) the means to fine facilities small and large; a capability they didn’t fully have the in the past.

Now, the OCR is setting out to be the new IRS of the healthcare world. Fines can be “as little” as a couple thousand dollars, but in many cases, without complete HIPAA policies in place, fines can go up to $25,000 per instance.

Patient rights are increasing: they can now instigate civil litigation and receive a portion of the settlements.
